SwiftBike Courier (“SwiftBike,” “we,” “us,” or “our”) provides on-demand and scheduled delivery services through our websites, mobile applications, and dispatch tools (collectively, the “Platform”). These Terms of Service (the “Terms”) govern your access to and use of the Platform. By creating an account, placing a delivery order, or accepting a courier engagement, you agree to these Terms.
1. Eligibility & Accounts
You must be at least 18 years old and capable of entering into a binding contract. When creating a SwiftBike account you must provide accurate and complete information, keep your credentials secure, and promptly update any changes. You are responsible for all activity conducted under your account.
2. Services
SwiftBike connects senders with independent courier contractors who collect, transport, and deliver approved items. We may decline or cancel any request that violates these Terms, applicable law, or safety guidelines. We may modify or discontinue services at any time.
3. Prohibited items
You may not ship illegal goods, weapons, controlled substances, live animals, perishable goods that cannot be safely transported by bike, hazardous materials, or cash equivalents exceeding $500. SwiftBike reserves the right to open and inspect items if required by law enforcement or to ensure compliance.
4. Orders & delivery
- Provide accurate pickup and dropoff details, contact information, and delivery instructions.
- Ensure items are securely packaged, labeled, and ready at the scheduled pickup time.
- Recipient availability is your responsibility. Additional wait time, redelivery, or return trips may incur extra fees.
5. Courier obligations
Couriers engaged via SwiftBike are independent contractors. They must comply with local regulations, maintain a roadworthy bicycle and safety gear, carry required insurance, and follow SwiftBike dispatch procedures. Couriers control how they complete deliveries provided they meet service-level expectations.
6. Pricing & payments
- Pricing combines a base fare, distance rate, time-based charges, and optional extras. Fees are displayed before you confirm an order.
- Payments are processed at the time of booking. Business accounts may receive invoicing or direct billing per a separate agreement.
- Tips are optional and paid in full to couriers.
7. Cancellations & refunds
Cancellations before courier assignment incur no charge. Once a courier is en route, a cancellation fee may apply. After pickup, refunds are evaluated case by case. Contact support@swiftbike.co with order numbers for resolution.
8. Insurance & claims
SwiftBike provides limited coverage up to $100 per delivery for loss or damage caused by courier negligence. Coverage excludes prohibited items, inadequate packaging, or events outside a courier’s control. Claims must be submitted within 48 hours of delivery completion.
9. Platform usage
You may not misuse the Platform by attempting unauthorized access, interfering with operations, reverse engineering code, or using bots to scrape data. We may suspend or terminate access if we detect suspicious or abusive activity.
10. Data & privacy
Your use of SwiftBike is also governed by our Privacy Policy, which explains how we collect, use, and share personal information. By using the Platform you consent to those practices.
11. Intellectual property
All trademarks, logos, and Platform content are owned by SwiftBike or our licensors. You may not use them without our written permission.
12. Disclaimers
The Platform is provided on an “as is” basis. SwiftBike disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose. We do not guarantee uninterrupted service or delivery times.
13. Limitation of liability
To the maximum extent permitted by law, SwiftBike’s total liability for any claim relating to the Platform will not exceed the fees you paid to us for the delivery at issue in the 3 months before the event giving rise to liability. SwiftBike is not liable for indirect, incidental, special, or consequential damages.
14. Indemnification
You agree to indemnify and hold harmless SwiftBike, its directors, officers, employees, and agents from any claims, damages, or expenses arising from your misuse of the Platform, violation of these Terms, or infringement of third-party rights.
15. Dispute resolution
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute will be resolved through binding arbitration administered by the American Arbitration Association in New York County, unless prohibited by law.
16. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced via email or in-app notice. Continued use of the Platform after updates constitutes acceptance.
